The department of registration and stamps has started its e-registration system, which will facilitate registration of Rental Agreements online. So people can complete the online registration at any time of the day.
Registration of leave and license agreement is mandatory in Maharashtra and the period of leave and license ranges from 11 months to 5 years.
WHAT IS A LICENSE?
A license is a personal right granted to a person to do something upon immovable property of the grantor and does not amount to the creation of interest in the property itself. It is purely a permissive right and is personal to the grantee. It creates no duties and obligations upon the persons making the grant and is, therefore, revocable except in certain circumstances expressly provided for in the Act itself. The license, when granted, has not other effect to confer liberty upon the licensee to go upon the land which would otherwise be lawful.
Section 52 of Indian Easement Act, 1882 defines License as under:
“Where one person grants to another, or to a definite number of other persons, a right to do or continue to do, in or upon immovable property of the grantor, something which would, in the absence of such rights, be unlawful, and such right does not amount to an easement or an interest in the property, the right is called a license.”

Leave and license e-registration is an online process for registering rental agreements in Maharashtra, available on the https://efilingigr.maharashtra.gov.in/ereg/ & https://leaveandlicense.igrmaharashtra.gov.in/ websites. It allows citizens to prepare, execute, and register their agreement online by paying stamp duty and registration fees through the GRAS portal. The process requires a biometric device for identity verification of all parties, and the final registered document can be accessed online.
Key aspects of the e-registration process:
Online platform: The registration is conducted through the e-filing portal of the Department of Registration and Stamps, Government of Maharashtra.
Online payment: Stamp duty and other fees are paid online via the GRAS (Government Receipt Accounting System) portal.
Biometric verification: All parties involved (landlord, tenant, and witnesses) must have an Aadhaar number and use a biometric device for thumb impression and identity verification.
Remote registration: The process can be completed from anywhere, eliminating the need to visit a Sub-Registrar Office (SRO).
Required documents: Essential documents include Aadhaar cards for all parties, the property's ownership proof (like an Index-2 form), and a PAN card.
